An agent is representing a seller. A prospective buyer-customer asks if the agent knows of any reason why the property might be overvalued. The agent knows a major zoning change is being discussed by the city that would allow a landfill two blocks away. The agent must:

  1. Deny knowledge to protect the seller's property value.
  2. Tell the buyer to check with the city and refuse to answer.
  3. Disclose the potential zoning change and landfill as a material fact.
  4. Tell only the buyer's agent, if they have one, and let them decide what to say.
