An applicant's old criminal record was legally expunged - that is, erased by a court. The N-400 still asks whether they have EVER been arrested or convicted.

What should the applicant do about the expunged record?

  1. Leave it out, because the court legally erased the record.
  2. Still disclose it truthfully, even though it was expunged.
  3. Leave it out, since it is no longer public anywhere.
  4. Mention it only if the officer already seems to know.
