National Real Estate Exam Glossary

A financing instrument used in lieu of a mortgage in many states, involving three parties: the borrower (trustor), the lender (beneficiary), and a neutral third party (trustee) who holds bare legal title and can conduct a nonjudicial foreclosure upon default. Functionally it secures the debt much as a mortgage does but typically permits a faster, out-of-court sale.
