In intellectual property law, the doctrine of fair use provides a limited exception to the exclusive rights of a copyright holder, allowing the public to use copyrighted material without permission for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. To determine whether a particular use is fair, courts consider four factors: the purpose and character of the use, including whether it is of a commercial nature or is for nonprofit educational purposes; the nature of the copyrighted work; the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and the effect of the use upon the potential market for or value of the copyrighted work. The fair use doctrine is intended to balance the interests of creators in controlling and profiting from their work with the interest of the public in the free exchange of ideas. In the digital age, however, the application of fair use has become increasingly complex, as new technologies facilitate the rapid and widespread reproduction and modification of copyrighted content.
