Prescription

National Real Estate Exam Glossary

The acquisition of an easement—a right to use, not to own—over another's land through open, continuous, and hostile use for the statutory period. A prescriptive easement is the use-right analog of adverse possession; the key distinction is that prescription yields a right of use, while adverse possession yields title.
