Automatic Stay
Corporate Credit Analysis glossary · Corporate Credit Analysis
Definition
Upon filing of a US bankruptcy petition, all collection actions against the debtor are suspended automatically. Provides the debtor breathing space to formulate a plan and protects estate value from creditor races.
Automatic Stay in plain English
When a US company can't pay its debts and files for bankruptcy, the automatic stay is an instant legal 'freeze' button: the moment the paperwork is filed, everyone the company owes must stop trying to collect: no seizing property, no lawsuits, no phone calls demanding money. The point is to prevent a chaotic free-for-all where the fastest, most aggressive creditors grab everything and destroy value for everyone else. Picture a referee blowing the whistle and freezing all players so the game can be sorted out fairly instead of turning into a stampede. This pause gives the company breathing room to organize a repayment plan.
